Former Nairobi Provincial Commissioner Davis Nathan Chelogoi has been convicted in a Sh1.35 billion land fraud case involving a 7.39-hectare parcel in Lower Kabete, Nairobi.
The Office of the Director of Public Prosecutions (ODPP) announced that Chelogoi was found guilty of five counts linked to an alleged scheme to defraud three landowners of the property situated along Lower Kabete Road.
The land, identified as Nairobi/Block/80/44, measures approximately 7.39 hectares and is valued at Sh1.35 billion.

According to the ODPP, the court convicted Chelogoi of conspiracy to defraud, forcible detainer, two counts of forgery and one count of uttering a forged document.
The case centred on an allotment letter dated January 31, 1995, which the court found Chelogoi had forged to make it appear as a genuine document issued by the Commissioner of Lands.
The court also found that on October 11, 2023, Chelogoi knowingly presented a forged allotment letter and a certificate bearing a forged signature and stamp impression of Paul Achieng Pesa at the Directorate of Criminal Investigations (DCI) headquarters along Kiambu Road.

The documents were allegedly presented as genuine records issued by the relevant land authorities.
19 witnesses testified in the case
The prosecution, led by Sonia Njoki, Hillary Isiaho and James Murage, called 19 witnesses and presented documentary and expert evidence to support the five charges against the former provincial commissioner.
The evidence was used to demonstrate the alleged conspiracy and the use of forged documents in the disputed ownership of the valuable Lower Kabete property.
Court orders cancellation of parallel titles
In addition to the conviction, the court ordered the land register to cancel any parallel title or registration issued in relation to the property.
The court ruled that the land belonged to Ashok Rupshi Shah and Hitebkumar Amritlal Raja, the claimants identified in the case.

Following the conviction, Chief Magistrate Dolphina Alego cancelled Chelogoi’s bond terms and ordered that he be remanded at Nairobi Remand pending mitigation and sentencing.

The court scheduled mitigation and sentencing for November 2, 2026.
The sentencing will determine the punishment to be imposed following the conviction.
The ODPP said the outcome followed the prosecution’s presentation of witness testimony and documentary evidence in support of the charges.
